Davidian trial judge subpoenaed

WACO - The federal judge who presided over the civil and criminal Branch Davidian trials has been subpoenaed by Special Counsel John Danforth and could appear before a grand jury as early as next week in St. Louis, the Waco Tribune-Herald reported Saturday.
   Citing anonymous sources, the newspaper said Judge Walter Smith - who presided over the Branch Davidian criminal trial in 1994 and the civil wrongful death trial in July - was subpoenaed Friday.
   After a 10-month independent investigation, Danforth in July issued a preliminary report clearing the federal government of wrongdoing in the deadly siege of the Davidian complex near Waco in 1993.
